今天收到老婆寄来的书，其中有刑案汇览三编，厚厚四大本。邱澎生说：《刑案滙覽》主要收錄「情節疑似」或是「例無專條」等兩類「疑、難」法律案件，本書可謂是中央司法官員對全國難度較高司法案件的解釋匯編。我没本事研究法律史，只能将其当作清代的《法制文学》来看。暂时也没空看，有兴趣的可以看看邱澎生：《淺析〈刑案匯覽〉的知識史》。

寄书中还有一本那思陆撰清代中央司法审判制度

作者曾作短文介绍这本书：
清代法制（包括司法審判制度）是中國傳統法制的一部分，它是中國傳統法制的珍貴遺產。清朝是我國君主政治最末的一個王朝，它是滿族建立的王朝。滿族雖以少數民族入主中原，但在取得政權之後，即接受了明朝的典章制度，包括明朝的政治制度與法律制度。清朝是中國傳統法制最末的繼承者，它居於「承先啟後」的關鍵地位。
清代司法審判制度應分為下列三個階段：
第一階段：天命元年至崇德八年（一六一六～一六四三年），共廿八年，這是部族習慣法時代。
第二階段：順治元年至光緒卅一年（一六四四～一九○五年），共二百六十二年，這是繼受明朝法制時代。
第三階段：光緒卅二年至宣統三年（一九○六～一九一一年），共六年，這是繼受歐陸法制時代。
清入關前的司法審判制度以滿族固有的傳統為基礎，以「合議審判」和「部族習慣法」為其特徵，極具民族特色。「合議審判」為氏族民主制的表現，這種傳統可以追溯到遼金時期。就廣義而言，「合議審判」的傳統亦係「部族習慣法」。
清入關後，其司法審判制度迅速採行明制。明代中央司法審判機關以三法司（刑部、都察院、大理寺）為主，清制亦同。除三法司外，清代得兼理司法審判之機關極多，議政衙門、內閣、軍機處、吏部、戶部、禮部、兵部、工部、理藩院、通政使司、八旗都統衙門、步軍統領衙門、五城察院、宗人府、內務府等機關均得兼理司法審判，都屬廣義之司法審判機關。
光緒卅二年（一九○六年），清改革官制，變更了傳統的三法司制度。刑部改名法部，大理寺更名大理院，法部掌理司法行政，大理院掌理審判並配置總檢察廳。至此，清代中央各機關之司法審判權亦被取消，司法審判集中於大理院，清代司法審判制度為之一變。
刑部為「刑名總匯」，其職掌兼有司法審判及司法行政，三法司中，刑部有關司法審判之職權最重，清史稿曰：「外省刑案，統由刑部核覆。不會法者，院寺無由過問，應會法者，亦由刑部主稿。在京訟獄，無論奏咨，俱由刑部審理，而部權特重。」都察院職司風憲，號風憲衙門。大理寺職司平決，係純粹之司法機關，兩衙門之職掌均兼有司法審判及司法行政。內閣之主要職掌係為皇帝處理題本，所有有關司法審判之題本，均經由內閣處理。軍機處之主要職掌係為皇帝處理奏摺，所有有關司法審判之奏摺，多由軍機處處理。
清代各省司法審判機關層級頗多，自州縣廳至省，各級衙門均擁有司法審判權，州縣廳係初審機關，其餘各級衙門均係覆審機關。各級司法審判機關因案件刑責之輕重而定其審級管轄。第一級司法審判機關為州縣廳，第二級司法審判機關為府、直隸州、直隸廳，第三級司法審判機關為道，第四級司法審判機關為按察使司，第五級司法審判機關為督撫。
依大清律例規定，無關人命徒罪案件，督撫即可批結。此類案件，按察使司每季造冊詳報督撫，督撫出咨報部。有關人命徒罪案件及軍流罪案件，督撫專案咨部核覆，年終彙題。情罪重大罪應凌遲斬梟斬決之案，督撫應專摺具奏，其餘尋常罪應凌遲斬梟斬決之案（應亦含絞決及斬絞監候案件），督撫應專本具題。由府審轉時，督撫為第四審，由道審轉時，督撫或為第四級審或為第五審。
應由刑部核擬具奏之案完全由刑部核覆，應由三法司核擬具奏之案，亦由刑部主稿，故三法司中刑部之權最重。無論專本具題或專摺具奏之死罪案件，絶大多數均由刑部主稿。惟專本具題之死罪案件須由三法司會同覆核，其程序較為繁複。
各省死罪案件題本，三法司覆核後具題，奏聞於皇帝。此時，內閣應票擬意見，內閣之票擬，絶大多數為單籤，但遇有特殊情形，內閣亦得票擬雙籤、三籤或四籤，依實際需要定擬不同處理意見。各省死罪案件奏摺奉旨刑部議奏（或刑部核擬具奏，少數案件亦有奉旨三法司核擬具奏者）後，刑部（或三法司）覆核後具奏，軍機大臣即奉旨會商擬辦。
各省死罪案件題本經三法司覆核奉旨依議後，即已結案。惟斬絞立決案件與斬絞監候案件不同，斬絞立決案件情節較為重大，結案之後，各省應依部文立即執行。而斬絞監候案件，其情節較輕。為慎重決囚起見，明清兩代逐漸發展出兩種慎刑制度，即秋審與朝審。秋審係就各省斬絞監候案件，每年加以覆核之制度；朝審係就京師斬絞監候案件，每年加以覆核之制度。
清代中央各部院雖均擁有部分司法審判權，惟清代司法審判之核心仍在刑部及三法司。就京師案件而言，五城察院及步軍統領衙門在體制上雖係中央機關，但在司法運作上，實係京師案件之初審機關，刑部及三法司均係覆審機關。京師案件第一級司法審判機關為五城察院及步軍統領衙門，第二級司法審判機關為刑部，第三級司法審判機關為三法司。
刑部現審之案件絶大多數均係徒罪以上案件。原則上，徒流軍遣罪案件，刑部得自行審結。死罪案件，則須由三法司會審。
無可諱言，清代司法審判制度，因受當時政治、經濟及社會發展等歷史條件之侷限，有其根本上之缺陷，諸如君主集權、行政機關兼理司法審判、採行糾問制度、允許刑訊取供及允許援引比附等。惟上述缺陷並非清代司法審判制度所特有，法國大革命以前歐陸各國之司法審判制度亦莫不皆然。法國大革命以後，歐陸各國陸續廢棄君主政治，採行民主政治，逐步建立以自由、民主及人權為基本精神之法制。歐陸法制因而脫胎換骨，面貌一新，與法國大革命以前之歐陸法制迥不相同。可斷言者，中國傳統法制實自法國大革命以後，始大幅度落後於歐陸各國。吾人認為，一昧肯定中國傳統法制，固非所宜，而全盤否定中國傳統法制，亦有欠妥當。
此书自序中这段斩钉截铁的话，深洽我心：
法史学工作者需要的是史料，不需要任何史观。摆脱一切史观的束缚，史料会说话，历史真相才有可能自然浮现。这就像法院在审理案件时，应该摆脱一切意识形态，案件的真相才有可能被发现。我是史料学派的支持者，我怀疑一切史观学派。换句轻松的话来说：“我是拼图派，我不是画图派”。所有的史观学派都喜好创造一个大理论，透过这个大理论描绘过去的历史，而且大胆的预测未来，他们几乎成了全能全知的上帝。从历史的观点来看，伟大的理论常会制造出伟大的错误。
我可能比他还激进一点。他还相信“真相”，我则压根怀疑有“真相”这个东西。
